The Department of Justice & Equality announces review of all cases where a link to the Zambrano ruling has been identified.

The Department of Justice & Equality is embarking on the examination of all cases where a link to the Zambrano judgement has been identified. The Zambrano judgment issued on the 8th of March by the European Court of justice precludes member states from refusing to grant rights of residence to non EU citizen parents of a minor European union citizens upon whom the minor EU citizen is dependant on.

The judgment is particularly relevant to the following category of people:

1.Parents of an Irish born child who are awaiting a decision on their application to remain.
2.Parents of an Irish born child who have a current permission to remain on stamp 2 or stamp 3 conditions.
3.Parents of an Irish born child who have already been deported or left the state on foot of a deportation order.

Persons who have already been deported or who have left the country on foot of a deportation order may apply to the relevant embassy or consulate in their country of origin for a visa to return to the State.
